Terms of Service - Inheritfy

1. Acceptance of Terms

By accessing or using Inheritfy ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Inheritfy is a digital inheritance platform that allows users to:

Store documents and files in encrypted vaults
Designate beneficiaries to receive documents upon verified passing
Appoint trustees to verify life status
Configure automated delivery of documents based on verification
Create Time Capsules for scheduled delivery of messages and files
Set up Emergency Access links for incapacitation scenarios

3. Account Registration

To use Inheritfy, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

4. Subscription and Payments

Subscription Plans

We offer three subscription tiers: Starter ($4/month or $40/year), Premium ($11/month or $110/year), and Legacy ($19/month or $190/year). Annual billing provides savings compared to monthly payments.

Free Trial

New users receive a 14-day free trial. No payment is required during the trial period.

Billing

Subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. Prices are in USD and exclude applicable taxes.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5. Acceptable Use

You agree not to use the Service to:

Store illegal or prohibited content
Violate any applicable laws or regulations
Infringe on intellectual property rights
Transmit malware or harmful code
Attempt to gain unauthorized access to our systems
Interfere with other users' use of the Service

6. Your Content

Ownership

You retain full ownership of all documents and files you upload to Inheritfy. We do not claim any ownership rights over your content.

License

By uploading content, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service.

Encryption

Depending on your chosen encryption mode, your content may be encrypted in ways that prevent us from accessing it. You are responsible for maintaining any encryption keys required to access your content.

7. Beneficiaries and Trustees

When you designate beneficiaries or trustees, you represent that you have the authority to share their contact information with us and that they consent to receiving communications from us regarding your account.

Beneficiaries

Beneficiaries are individuals you designate to receive your documents and files upon verified passing. They will receive notifications and access to packages you have assigned to them once the verification process is complete.

Trustees

Trustees are trusted individuals who can verify your life status if you miss check-ins. They act as a safeguard against false triggers and help ensure your documents are only released when appropriate.

Dual Roles

Individuals may serve as both a beneficiary and a trustee, allowing them to both verify your status and receive documents.

8. Life Status Verification

The Service uses various methods to verify your life status, including check-in prompts and trustee verification. You understand that:

The Service relies on timely responses to check-ins
Failure to respond may trigger verification protocols
Document release occurs only after verification thresholds are met
We are not liable for false positives or delays in verification

9. Time Capsules

Time Capsules allow you to schedule delivery of messages and files to specified recipients at a future date. You understand that:

Time Capsules support server-side encrypted (SSE) files only; client-side encrypted files cannot be included
Recipients must confirm their email address before the scheduled delivery date
Delivery occurs automatically at the scheduled time without requiring life status verification
Once a Time Capsule is scheduled, you may edit or cancel it before the delivery date
Time Capsule limits (number of capsules, recipients, file sizes) vary by subscription tier
We are not liable for delivery failures due to invalid recipient email addresses

10. Emergency Access

Emergency Access (also known as "Break the Glass") allows you to create secure links that grant trusted individuals access to your vault in case of incapacitation. You understand that:

Emergency Access is designed for incapacitation scenarios, not death verification
You control the waiting period (1 hour to 14 days) before access is granted
You will be notified when someone requests Emergency Access, giving you time to block the request if it was unauthorized
Emergency Access provides read-only access; recipients cannot modify your vault
The link secret (URL fragment) is never transmitted to our servers for security
You may revoke or expire Emergency Access links at any time
Emergency Access can be scoped to your entire vault or specific sealed packages

11. Limitation of Liability

To the maximum extent permitted by law, Inheritfy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of data or documents
Unauthorized access to your account
Delays in document delivery
Errors in life status verification
Service interruptions or downtime
Time Capsule delivery failures or delays
Emergency Access link misuse by third parties

12. Indemnification

You agree to indemnify and hold harmless Inheritfy, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Intellectual Property

The Inheritfy name, logo, and all related marks are trademarks of Inheritfy. The Service, including all software, designs, and content (excluding user content), is protected by copyright and other intellectual property laws.

14. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your access to stored documents may be revoked. We recommend exporting your data before canceling your subscription.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

17. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
